Fundación Buena Semilla (hereinafter 'the Foundation') complies with Statutory Law 1581 of 2012, Decree 1377 of 2013 and all applicable Colombian regulations on personal data protection. This policy explains how we collect, use, store and protect your data, and what rights you have as a data subject.

Data we collect

We only collect data that you voluntarily provide through:

  • Contact form: name, email address and message.
  • Sponsorship form: name, email, phone number and country of residence.
  • Volunteer form: name, email, phone number and availability.
  • WhatsApp: data you share when starting a conversation.

We do not collect sensitive data (racial origin, health, biometrics, etc.) or data from minors under 18 without authorization from their legal representative. We do not use tracking cookies or third-party analytics tools without your prior consent.

Purposes of processing

Your data is used exclusively to:

  • Respond to your requests for information, donations or volunteering.
  • Manage the sponsorship program and send quarterly updates.
  • Coordinate volunteering activities.
  • Send communications about projects, events and impact (only if you authorize it).
  • Comply with legal and tax obligations applicable to nonprofit organizations.

We do not sell, transfer or share your data with third parties for commercial purposes. We may share strictly necessary data with service providers (transactional email) under confidentiality agreements.

Legal basis and consent

Processing is based on your explicit consent, granted when you fill out any of our forms. You may revoke this consent at any time by writing to fundacionbuenasemilla@gmail.com.

Data retention

We retain your data for as long as necessary to fulfill the purpose for which it was collected and to meet potential legal obligations. Active sponsor data is maintained for the duration of the relationship. Upon termination, data is deleted or anonymized within a maximum period of 12 months.

Your rights (Habeas Data)

Under Law 1581 of 2012, you have the right to:

  • Know the data we hold about you.
  • Update inaccurate or incomplete data.
  • Rectify erroneous data.
  • Delete your data when there is no legal obligation to retain it.
  • Revoke your processing authorization.
  • File complaints with the Superintendence of Industry and Commerce (SIC).

To exercise any of these rights, send a request to fundacionbuenasemilla@gmail.com with the subject line 'Habeas Data.' We respond within a maximum of 10 business days, extendable to 15 days as per the Law.

Cookies and tracking technologies

This site uses only essential technical cookies necessary for proper operation (session, language preference). We do not install analytics or advertising cookies without your consent. If we integrate analytics tools in the future (Google Analytics, Meta Pixel, etc.), we will update this policy and request your prior consent via a cookie banner.

We implement reasonable technical and organizational measures to protect your data against unauthorized access, loss or disclosure: encrypted communications (HTTPS/TLS), role-based access control and storage on servers with recognized security standards. In the event of a security breach affecting your rights, we will notify you without undue delay.
